And though it may appear that the bin\u00adding power of his words is deri\u00adved from the force of his will or from a prior autho\u00adri\u00adty, the oppo\u00adsite is more true&nbsp;: it is through the cita\u00adtion of the law that the figure of the judge\u2019s \u201cwill\u201d is pro\u00addu\u00adced and that the \u201cprio\u00adri\u00adty\u201d of tex\u00adtual autho\u00adri\u00adty is esta\u00adbli\u00adshed. Indeed, it is through the invo\u00adca\u00adtion of conven\u00adtion that the speech act of the judge derives its bin\u00adding power&nbsp;; that bin\u00adding power is to be found nei\u00adther in the sub\u00adject of the judge nor in his will, but in the cita\u00adtio\u00adnal lega\u00adcy by which a contem\u00adpo\u00adra\u00adry \u201cact\u201d emerges in the context of a chain of bin\u00adding conventions.<\/p>\n<p>Where there is an \u201cI\u201d who utters or speaks and the\u00adre\u00adby pro\u00adduces an effect in dis\u00adcourse, there is first a dis\u00adcourse which pre\u00adcedes and enables that \u201cI\u201d and forms in lan\u00adguage the constrai\u00adning tra\u00adjec\u00adto\u00adry of its will. Thus there is no \u201cI\u201d who stands behind dis\u00adcourse and exe\u00adcutes its voli\u00adtion or will through dis\u00adcourse. On the contra\u00adry, the \u201cI\u201d only comes into being through being cal\u00adled, named, inter\u00adpel\u00adla\u00adted, to use the Althusserian term, and this dis\u00adcur\u00adsive consti\u00adtu\u00adtion takes place prior to the \u201cI\u201d; it is the tran\u00adsi\u00adtive invo\u00adca\u00adtion of the \u201cI.\u201d Indeed, I can only say \u201cI\u201d to the extent that I have frst been addres\u00adsed, and that address has mobi\u00adli\u00adzed my place in speech&nbsp;; para\u00addoxi\u00adcal\u00adly, the dis\u00adcur\u00adsive condi\u00adtion of social recog\u00adni\u00adtion pre\u00adcedes and condi\u00adtions the for\u00adma\u00adtion of the sub\u00adject&nbsp;: recog\u00adni\u00adtion is not confer\u00adred on a sub\u00adject, but forms that sub\u00adject.
